Welcome to The Cube Vault.

The terms “we”, “us” and “our” refer to The Cube Vault, ABN 84 768 973 681.

The Cube Vault operates this website and online store, including its information, content, features, products and services. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.

These Terms of Service explain the conditions that apply when you visit our website, create an account, place an order or otherwise use our services.

By accessing or using this website, you agree to these Terms of Service and the policies referred to within them. These policies include our Privacy Policy, Shipping Policy and Returns and Refunds Policy.

Please do not use our website or place an order if you do not agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available to you under the Australian Consumer Law or any other law that cannot legally be excluded.

Section 1: Eligibility and Accounts

You must be at least 18 years old to place an order, or have permission from and be supervised by a parent or legal guardian.

When using our website or placing an order, you agree to provide accurate, current and complete information. This may include your name, email address, billing information, delivery address and payment details.

You are responsible for:

1. Ensuring that the information you provide is correct
2. Maintaining the security of your account and password
3. All activity performed through your account
4. Informing us if you believe your account has been accessed without permission

You must not transfer, sell or provide your account to another person without our written approval.

We may suspend or close an account where we reasonably believe that it has been used fraudulently, unlawfully or in breach of these Terms.

Section 2: Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and availability information are accurate.

Product colours and appearance may vary slightly depending on your device, screen settings, lighting and manufacturing variations.

Packaging, accessories and minor product details may change between production batches. These changes do not necessarily mean that the product is defective.

Product images are provided for general reference. Unless otherwise stated, accessories or decorative items shown in photographs may not be included.

We may update product descriptions, prices or availability at any time. We may also discontinue a product or limit the quantity available for purchase.

Nothing in this section limits your rights where a product does not match its description, is not of acceptable quality or does not meet another consumer guarantee under the Australian Consumer Law.

Section 3: Custom and Personalised Products

Some products may be customised using photographs, text, images or instructions provided by you.

When submitting content for a customised product, you confirm that:

1. You own the content or have permission to use it
2. The content does not infringe another person’s copyright, trademark, privacy or other rights
3. The content is not unlawful, abusive, threatening, discriminatory, obscene or otherwise inappropriate
4. The content does not contain malicious software or harmful material

We may refuse a custom order where the submitted material does not meet these requirements.

You are responsible for checking the images, spelling, design choices and instructions submitted with your custom order. Colours, cropping and positioning may vary slightly during production.

Custom products cannot generally be returned because of a change of mind. This does not affect your rights if the product is faulty, damaged, incorrectly produced or otherwise does not comply with the Australian Consumer Law.

Section 4: Orders and Acceptance

Placing an order is an offer to purchase products from The Cube Vault.

An automated order confirmation means that we have received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when we confirm acceptance or dispatch the products, whichever occurs first.

We may refuse or cancel an order where:

1. A product is unavailable
2. Payment cannot be authorised
3. Product or pricing information contains a genuine error
4. We reasonably suspect fraud, misuse or unauthorised activity
5. The order breaches these Terms
6. We cannot legally supply the product to the delivery location

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled items to the original payment method.

Please review your order carefully before submitting it. Contact us as soon as possible if you need to request a change or cancellation. We cannot guarantee that an order can be changed or cancelled after processing or production has begun.

Section 5: Prices and Payment

Unless otherwise stated, all prices displayed on our website are in Australian dollars.

Prices, discounts and promotions may change without notice. The price charged will be the price displayed when you place your order, unless there is an obvious pricing or technical error.

Shipping charges and any other applicable fees will be shown during checkout before payment is completed.

You agree to provide accurate and authorised payment information. By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payments may be processed by Shopify Payments or another payment provider. These providers may have their own terms and privacy practices.

For international orders, customers are responsible for any customs duties, import taxes or other charges imposed by the destination country. These charges are not controlled by The Cube Vault.

Section 6: Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, including expiry dates, minimum order amounts, eligible products and limits on use.

Unless otherwise stated:

1. Discount codes cannot be combined
2. Discount codes cannot be exchanged for cash
3. Discount codes cannot be applied after an order has been completed
4. A discount code may be limited to one use per customer

We may cancel or refuse a discount where we reasonably believe that it has been used fraudulently, incorrectly or contrary to its stated conditions.

Section 7: Shipping and Delivery

Orders are processed and delivered according to our Shipping Policy.

Delivery dates and timeframes are estimates rather than guarantees. Delivery may be affected by carrier delays, customs processing, public holidays, weather events, incorrect address information or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you discover an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

Risk in the products passes to you when the order is delivered to the address provided at checkout, or collected by you or a person authorised by you.

Nothing in this section limits any rights you may have where goods are not delivered within an agreed or reasonable time.

Section 8: Returns, Refunds and Consumer Rights

Returns, refunds and gift cards are handled according to our Returns and Refunds Policy.

Our change of mind policy is separate from your rights under the Australian Consumer Law.

Products purchased from The Cube Vault come with consumer guarantees that cannot be excluded under the Australian Consumer Law. These guarantees may include that products:

1. Are of acceptable quality
2. Match their description
3. Are fit for any purpose made known to us
4. Match any sample or demonstration model
5. Are supplied with clear title and without undisclosed securities

If there is a problem with a product, contact admin@thecubevault.com with your order number and information about the issue.

Depending on the nature of the problem and your legal rights, an appropriate remedy may include a repair, replacement, refund or compensation for reasonably foreseeable loss.

Section 9: Gift Cards

Gift cards may be used to purchase eligible products through The Cube Vault website.

Gift cards:

1. Cannot be exchanged for cash, except where required by law
2. Must be protected like cash
3. May not be replaced if lost, stolen or used without permission, except where required by law
4. Cannot be used to purchase another gift card unless we state otherwise

Any expiry period will be displayed on the gift card or in the conditions provided at purchase.

Section 10: Acceptable Use

You may use our website only for lawful purposes.

You must not:

1. Use the website to violate any law or regulation
2. Provide false, deceptive or misleading information
3. Attempt to gain unauthorised access to the website, another person’s account or our systems
4. Upload viruses, malicious software or harmful code
5. Interfere with the security or operation of the website
6. Collect personal information about other users without permission
7. Send spam, fraudulent messages or unauthorised advertising
8. Impersonate another person or organisation
9. Use automated systems to scrape, copy or extract website content without written permission

You must not reproduce, distribute, sell, modify, publish or commercially use our content without written permission, except where permitted by law.

Third party brands, product names, logos and trademarks displayed on our website remain the property of their respective owners.

Section 12: Reviews, Feedback and Submitted Content

You may submit product reviews, photographs, suggestions or other feedback where this functionality is available.

You confirm that anything you submit:

1. Is accurate and based on your genuine experience where presented as a review
2. Does not infringe another person’s rights
3. Is not unlawful, misleading, abusive, obscene or discriminatory
4. Does not contain confidential information, spam or malicious software

By submitting content, you give The Cube Vault a non exclusive, worldwide and royalty free permission to use, reproduce, display and share that content for operating and promoting our business.

You continue to own your original content.

We may moderate or remove submitted content where we reasonably believe it is unlawful, misleading, irrelevant or in breach of these Terms. We will not remove a genuine negative review merely because it is critical of our products or services.

Section 13: Third Party Services and Links

Our website may contain links to services operated by third parties, including payment providers, delivery providers, social media platforms and other websites.

These third parties operate independently from The Cube Vault. Their own terms and privacy policies may apply when you use their services.

We are not responsible for the content, security, availability or conduct of third party websites that we do not control.

A link to another website does not necessarily mean that we endorse that website or its products.

Section 14: Relationship With Shopify

The Cube Vault uses Shopify to host and operate its online store.

Purchases made through this website are transactions directly between you and The Cube Vault. Shopify is not the seller of the products offered by The Cube Vault.

Shopify may collect and process information as necessary to host the store, process transactions, prevent fraud and provide its services. Further information is available in our Privacy Policy and Shopify’s own privacy documentation.

Section 15: Privacy

Personal information collected through our website is handled according to our Privacy Policy and applicable privacy laws.

Information may also be processed by Shopify and other providers that assist us with payments, website hosting, communications, fraud prevention, analytics and delivery.

You are responsible for ensuring that any personal information you provide is accurate and that you have permission to provide it.

Section 16: Errors and Availability

Our website may occasionally contain errors relating to product descriptions, prices, promotions, shipping costs, availability or other information.

To the maximum extent permitted by law, The Cube Vault is not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.

We are not responsible for loss caused by:

1. Your failure to follow product instructions
2. Misuse, modification or improper maintenance of a product
3. Unauthorised access resulting from your failure to protect your account details
4. A third party service or website outside our reasonable control
5. An event outside our reasonable control

This section does not limit liability for fraud, wilful misconduct, personal injury caused by negligence or any other liability that cannot legally be limited.

Section 18: Indemnity

To the extent permitted by law, you agree to compensate The Cube Vault for reasonable losses, costs or claims arising directly from:

1. Your unlawful use of the website
2. Your serious or intentional breach of these Terms
3. Content you submit that infringes another person’s rights

This section does not require you to compensate us for loss caused by our own negligence, breach of law or wrongful conduct.

Section 19: Suspension and Termination

These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.

You and The Cube Vault submit to the jurisdiction of the courts of Western Australia and any courts that may hear appeals from them.

Nothing in this section removes any right you may have to bring a claim in another jurisdiction where that right cannot lawfully be excluded.

Section 24: Changes to These Terms

We may update these Terms when our business practices, services or legal obligations change.

The current version will be published on this page with the date it was last updated.

Changes will apply from the date they are published, unless a later date is stated. Changes will not remove rights that arose before the updated Terms took effect.

Continued use of the website after an update means that the updated Terms will apply to your future use of the website.

Section 25: Entire Agreement

These Terms, together with the policies referred to in them, form the agreement between you and The Cube Vault concerning your use of the website and purchases made through it.

If there is an inconsistency between these Terms and a specific promotion or product condition, the more specific condition will apply to that promotion or product, provided it complies with applicable law.
